Tosin Oloyede, a teenager, was remanded on Wednesday by an Ikeja Magistrate's Court in Ogba, Lagos State, for allegedly raping a five-year-old girl during the state's presidential and National Assembly elections.
In order to wait for legal counsel from the Directorate of Public Prosecution, Magistrate Mrs. B. O. Osusanmi confined the defendant to the Special Correctional Institution for Boys in Oregun.
The accused, a 16-year-old boy, is accused of defiling his neighbor's daughter about 2 pm in the state of Ikorodu, according to the prosecution, Assistant Superintendent of Police Akeem Raji, who testified in court.
Oloyede defiled the woman by engaging in sexual activity with her, according to Raji.
The prosecutor asserts that the offense violated Section 27 and is penalized in accordance with Section 210(8) of the 2015 Child Right Law of Lagos State.
When the defendant was brought before the court on a remand application, no plea was taken.
The woman started crying as soon as she saw the suspect who had raped her when the case was called in court on Wednesday.
Inspector Esther Igbineweka, the investigating police officer, informed Magistrate Osusanmi that the suspect made confessional statements at both the Igbogbo Police Station and the police command in Ikeja after the parents reported the incident.
"The defendant acknowledged to us that he had carnal knowledge with the victim," Igbineweka said.
In contrast, the suspect just acknowledged touching the girl in open court.
Abdulkareem Jagun, a lawyer, made an announcement of his presence on behalf of the complainant, while a lawyer also spoke on behalf of the defendant.
The victim's father claimed that because it being election day on the day of the event, he and his wife went out to vote.
On election day, we went to the polls, and when we got home, my son said that he was outside playing football when the boy sexually assaulted his sister.
“While he was playing the ball outside, he said he discovered that he didn’t see his sister and went in search of her. He told us that he caught the boy who is my neighbour’s son when he got inside the house.
When we returned, the child's parents begged him not to tell us, but my son stated there was no way the youngster could keep quiet about what had happened to his sister.
The case was postponed to April 12, 2023, so the DPP could provide legal counsel.
